The Ninth Circuit Court of Appeals rejected Kalshi's request for relief against Nevada gambling laws after the state sued the company in February for "unlicensed operations." The judge's reasoning was devastatingly simple: Kalshi advertises itself as "the first app for legal sports betting in all 50 states." When the company tried to argue in court that it is actually a "designated contract market" offering "event contracts" rather than gambling, the judge simply cited their own marketing copy back at them. Kalshi says they pulled the ad, but the damage was done.

The Regulatory Battle Over Prediction Markets

The core legal dispute comes down to whether companies like Kalshi and Polymarket are gambling platforms or something else. They argue they are "event contract markets" regulated solely by the Commodity Futures Trading Commission (CFTC), not by state gambling authorities. This distinction matters enormously for their business model. If classified as gambling, they would have to pay state taxes and comply with state regulations in every jurisdiction where they operate. If classified as federally regulated financial markets, they can operate in states like California and New York that have not legalized sports betting, capturing that revenue without state oversight.
